The Council of Ministers adopts an Ordinance for the order and manner of issuance and review of permits for emission of greenhouse gasses from installations and for realizing monitoring by the operators of installations and the aviation operators, participating in the EU Emission trading scheme. Along with it was adopted an Ordinance for the order and the manner of administration of National register for greenhouse gas emission allowance trading. The Ordinance for the permits regulate the order and manner of issuance and reviewing of the issued permits for the greenhouse gas emissions of operators of installations for industrial activities categories under annex № 1 to Climate change mitigation act (CCMA) and for realizing monitoring by the operators of installations and the aviation operators, participating in the EU Emission trading scheme (EU ETS).

Competent authority on issuing, reviewing, updating and withdrawing the permits and approving of the monitoring plans of the annual emissions from the installations is the executive director of the Executive agency on environment (EAE). The procedure of issuance of the permits is regulate on the ground of application submit electronically or on paper and declaration for the authenticity of the information. With the application shall be submit and monitoring plan electronically or on paper, drawn up in compliance with the requirements of the ordinance and Commission Regulation (EU) N 601/2012 of 21 June 2012 and Directive 2003/87/EC of the European Parliament and of the Council (OJ, L 181/30 of 12 June 2012). To application shall be enclose document for fee paid on the amount determined by the Tariff of fees collected by the Minister of Environment and Water, adopted by Decree № 136 of the Council of Ministers from 2011.

Officials from EAE and from corresponding Regional Inspectorate of Environment and Water can execute the checkup at the corresponding place in compliance with stated in the application and in the monitoring plan data. In cases of discrepancy and incompleteness shall be given the corresponding instruction for their removal. Within 10 days of its receipt the operators shall be able to make comments and objections and / or request a clarification on the draft permit, an integral part of which is the monitoring plan. It is provided an order for reviewing and withdrawal of the issued permits, as the competent authority shall make this review at least every five years and shall introduce the corresponding changes if necessary. The decisions of EAE executive director on issuing, reviewing, updating and withdrawing the permits as his decisions on approving and denial of approving of the monitoring plans of the annual emissions and data per tonne/km shall be individual administrative acts and shall be appealed under the terms and the order of Administrative – procedure Code (APC).
